Pest Control and Resident Rights

With a large percentage of new residents moving to Nevada for the first time, Las Vegas property managers are given the unique task of educating our new residents about the different types of pest, insects, and vermin that most people are not accustom to in different parts of the country.  Most people find it difficult to have scorpions, black widows, or cockroaches residing close to them.  The biggest obstacle Las Vegas property managers have is most residents are not aware the landlords are only responsible for pest control within the first 30 days of occupancy, per Nevada law, unless otherwise agreed upon in writing.

 

This leaves the resident in a precarious position once they discover these pests.  Most people don't want to pay a $40 - $80/monthly pest control service, but when the summer months come, and the cockroaches come out - all hell breaks loose!  We like to remind our residents prior to this, but many people choose not to take precautionary measures.  The Board of Realtors lease clearly states:

 

PEST NOTICE: TENANT understands that various pest, rodent and insect species (collectively, "pests") exist in

Southern Nevada. Pests may include, but are not limited to, scorpions (approximately 23 species, including bark

scorpions), spiders (including black widow and brown recluse), bees, snakes, ants, termites, rats, mice and pigeons.

The existence of pests may vary by season and location. Within thirty (30) days of occupancy, if the Premises has

pests, LANDLORD, at TENANT's request, will arrange for and pay for the initial pest control spraying. TENANT

agrees to pay for the monthly pest control spraying fees. The names and numbers of pest control providers are in the

yellow pages under "PEST." For more information on pests and pest control providers, TENANT should contact the

State of Nevada Division of Agriculture at www.agri.nv.gov.


If you haven't done so, I highly recommend you invest into a monthly or at least quarterly pest service.  Unfortunately one trip to Home Depot won't cure the problem, but routine maintenance will definitely keep those critters away.
